How did you first learn about the business of wholesaling real estate? Did you read a book? Or hear it on a 2AM infomercial? Or perhaps you know someone in the business. No matter how you learned about it, you quickly caught on that there was money to be made in the business. You may have seen incredible examples of people who found bargain properties, purchased them for pennies on the dollar, turned around and made a nifty profit.


Of course all that is true. Wholesaling properties is a lucrative business, but there are a number of pitfalls and dangers to be aware of. Remember the old saying “To be forewarned is to be forearmed.” The highway to real estate fortunes is littered with well-intentioned people those who did not heed good advice. Let that not be said of you. Here are seven of the most common newbie mistakes to avoid.


1. No Cash Reserve


To jump into real estate investing with no cash reserves is pretty much a ticket to quick failure. I know – you’ve listened to all the infomercials and heard the gurus say “no money down,” “you need no cash,” and similar amazing claims. It sounds great, but the truth is you will have to have access to some cash. This may be your great credit (and your credit cards), it may be a partner who has cash reserves, it may be someone who believes in you who is willing to invest in your business. Somehow, some way, there must be available cash. Think about it – you can’t even buy a stack of bandit signs if you have no cash.


2. Lack of Knowledge and Expertise


Some people love to learn and soak up knowledge and instruction. Others feel that taking time to study (seminars, teaching CDs, books, webinars, etc.) is a waste of time. “Who needs it? I just want to jump in and get rolling.” Can that person become successful? Perhaps. But the chances are slim. Do you want your car tuned up by someone who has never been trained? Not me. There is so much good instruction available, it would be foolish not to take advantage of it. Whatever knowledge and training you can acquire – your future clients will thank you for it.


3. Failure to Market


In order to succeed in real estate investing you will need sellers who want to sell and buyers who want to buy. The only way you can find these people is by marketing. Yes, you can hire bird dogs (people to scour neighborhoods to find properties for you), but that is not all sufficient. The lack of a marketing plan and a marketing budget is a mistake that can be fatal to your new business. You must let people know you are in business, and you must let them know what you can do for them.


4. Ignoring the Internet


Closely related to marketing is the use of the Internet. In this day and age, there is no excuse for not taking advantage of all that is available on the Net. You can find simple do-it-yourself website programs with which you can set up a website and feature your properties. Learn about such things as email campaigns and autoresponders. Use free ad services such as CraigsList. Much of what is offered on the Internet is free for the taking. Not using these tools leaves a gaping hole in your marketing plan.


5. Paying Too Much


Another mistake that often puts newbies out of the game is the lack of ability to make a clear price analysis. This is an art that is learned over time. If you are flipping to a rehabber, you must factor in such items as repairs and holding costs. Failure to understand how to price will equal out to slim or no profits. No profits means no business.


6. Falling in Love with the Property


If you latch on to a beautiful piece of real estate, it’s difficult to keep emotions at bay. But that is the key to becoming a good investor. Emotions must not play a part in the decision making. If they do, it’s likely that unwise decisions will be made. The best advice is to hold all properties at arm’s length and remain as objective as possible.


7. Doing Nothing


Procrastination is a demon that will not only kill your enthusiasm; it will kill your entire business. If it is to become your source of income, treat it like a real business and not some hobby you’ve picked up. If you have determined that you want to make money in the real estate game, you must set up a work plan and follow it. If you do nothing – believe me, nothing is what will happen.

The investment quandary as to the best method for acquiring foreclosed property at heavily discounted prices inevitably surfaces at the same stage in the real estate cycle every ten to twenty years. After housing booms and home prices correct back to affordable levels, real estate investors are suddenly inundated with an almost overwhelming supply of potential homes to choose from. These prospective buyers peruse city blocks searching for evidence of distressed properties that might lead to investment opportunity by taking dead lawns, unpaid utility notices, and default notices all into account. They investigate “For Sale” signs with “Bank Owned” or “Foreclosure” riders attached. Technologically savvy bargain hunters browse websites online to identify properties in default. These opportunists also compare notes with one another at various social functions, water coolers, chat rooms, and anywhere else real estate is spoken. Here they may learn that in order to obtain the most lucrative price, investors are best served to purchase property directly at a foreclosure sale on the court house steps. Regardless of the preferred method for locating distressed properties, it is imperative to thoroughly comprehend the different foreclosure processes in order to develop and implement a successful investment strategy.

If a homeowner fails to make prescribed loan payments to the bank, the borrower is deemed to have defaulted on the loan. If the delinquent payments are not cured in a timely fashion, the lender is permitted to foreclose on the property to acquire title to the home as security for the unpaid debt. For national investors it is important to understand that lending practices and foreclosure procedures vary from state to state. For example, some states are considered “mortgage” states while other states prefer the “deed of trust” method of lending and holding title as security for the loan.

MORTGAGES

Mortgage states utilize a two party security system where a mortgagor (or borrower) provides a promissory note to a mortgagee (or lender), along with a voluntary lien called a mortgage that serves as security for the borrower’s promise to make the loan payments described in the promissory note. Since title to the property resides with the borrower when the mortgage is created, foreclosures in mortgage states can be relatively lengthy and costly for banks to pursue. Further, mortgages also provide borrowers redemption rights that allow borrowers a specified period of time after the foreclosure and ultimate sale to a third party to pay off the original loan amount and regain title to the property. As a result, buyers at foreclosure sales in mortgage states must be aware that they will often be unable to obtain clear title to foreclosed homes as the previous owner will likely be afforded the opportunity to pay off the original promissory note and reclaim the property.

DEEDS OF TRUST

A minority of states that include California favor the three party deed of trust system due to the relative cost efficiency and expediency provided to lenders in the foreclosure process. Additionally, lenders are often able to provide buyers of foreclosed property clear title as no right of redemption exists for borrowers. The Deed of Trust process involves a trustor (or borrower) that gives a promissory note to the beneficiary (or lender), and the trustor also gives title through a trust deed to a trustee (neutral third party) as security for the note. The important difference here is that title to the property is held by the trustee rather than the borrower. The trustee is typically a neutral third party designated by the lender to hold the deed of trust during the loan period with the power to more easily administer a foreclosure sale in case of default by the borrower.

It is clearly important to determine whether one is bidding on a property that was subject to a mortgage or a trust deed at a foreclosure sale. This differentiation can often be confusing as many real estate professionals and experts in deed of trust states will often casually refer to home loans as mortgages. Many lenders in these states will refer to themselves as mortgage brokers or mortgage companies when they actually originate promissory notes secured by deeds of trust. Deed of Trust states also refer to foreclosure sales as trustee’s sales, where the highest bidder purchases the property in an auction setting. However, purchasing a home at a trustee’s sale can be a risky proposition as the buyer has little or no opportunity to inspect the home prior to purchase. Further, the buyer must pay with all cash as financing is typically not permitted at trustee’s sales. There is also no guarantee that the property is not currently occupied by tenants or a previous owner. Finally, purchasers at a trustee’s sale are not protected against clouds on the property’s title like tax liens from a previous owner’s unpaid property taxes, so title insurance is often unattainable for buyers at trustee’s sales.

REAL ESTATE OWNED (REO)

If a home is not sold to a new buyer through the foreclosure process, the lender holding the promissory note will often acquire the property and attempt to sell it on the open market to a new buyer. Once title to the home that once served as security for the unpaid promissory note is transferred to the bank, the property is deemed real estate owned (REO) by the bank. The bank will then typically retain a REALTOR® to market the property for sale at a price below market value, remedy any defects on title, remove any tenants or squatters occupying the property, and often retain contractors to repair any major physical defects in existence on the property. Although the typical price paid for an REO property may in theory be slightly higher than buying at a foreclosure sale, purchasing an REO property is clearly a much less risky proposition. REO sales also provide investors adequate opportunity to inspect homes prior to making offers to purchase, and buyers are permitted to utilize financing when purchasing these bank-owned properties.

Whether purchasing foreclosed or REO properties, the various risks and rewards associated with an investment may not only depend on the characteristics of the home itself, but also the type of security the home provided to the previous owner’s lender. In order to avoid the displeasure of telling foreclosure horror stories in real estate investment circles, an ounce of diligent research into a property’s financial history can prevent a pound of investment headaches.

President Bush keeps reminding us and telling us that we’re in a rough patch but all will be well. Rough patch? Rough patch you say? I’d sure hate to see a bad patch. For example, home foreclosure in California is a HUGE PROBLEM! In fact, real estate values in California dropped in February by 26%! And a home foreclosure rate is nearly equal to the home purchase rate! That’s not a rough patch Bush.

Most commodities and gold dropped late last week and on Monday, but has recovered big time in the last two days. The major drop in Fed funds helped fuel the false sense of security in the stock market, but that’s all it was- a FALSE SENSE of security. The stock market is in trouble because our world house of financial cards is in trouble.

Signs of distress are piling up in the California housing market, where prices are falling at three times the national rate of decline. Welcome to California! Statewide, median sales prices fell by a stunning 26% from year-ago levels in February, with home prices dropping at a rate of nearly ,000 a week, the California Association of Realtors reports.

And check out these numbers.

In the San Fernando Valley, losing a home to foreclosure is now almost as common for families as buying a home. The L.A. Daily News reported that “During January and February, there were 1,084 foreclosures and 1,335 sales of houses and condos in Valley communities from Glendale to Calabasas. This is more than a rough patch. Real estate prices are in a “disaster patch”.

On a percentage basis, the California price meltdown is more than three times as severe as the national decline of 8.2% in median prices reported this week by the National Association of Realtors. On an absolute basis, the California meltdown is even more severe: Nationally, prices fell over the past year at a rate of 8 per week; in California, prices fell at a rate of ,788 per week.

Additionally, sales of new homes fell in February for the fourth straight month, pushing activity down to a 13-year low as the steep slump in housing continued. The Commerce Department reported Wednesday that new home sales dropped 1.8 percent last month to a seasonally adjusted annual rate of 590,000 units, the slowest sales pace since February 1995. The decline was slightly worse than expected.

The home foreclosure debacle is going to be with us for an extanded period of time. It will get worse before it gets better- the rough patch. :-(
